Family Court Cost Used As “Strategy”

It has been my experience that the only winner in court cases are the attorneys. In my case, the expense of court is used as part of moms strategy to alienate me from my daughters. Mom will insist on going to court knowing full well that she will loose, as long as it is financially draining on me. In this current round, I will have to add hotels and days off from work because I now live so far away. This is a post from Fathers Unite that talks about the cost of court battles.

Family courts today are not a solution for divorcing parents, but a hindrance to the process and very harmful to children and families. Unfortunately this is a simple scientific and statistical fact – NOT AN OPINION.  Over 80% of custody awards are for sole custody and this has been proven the absolute WORST arrangement for children – yet it is the easiest and most profitable for lawyers and the states. Therefore it is a fact that divorce courts today are destroying millions of children’s chances of growing up normal. In fact the chance of divorce of a child later in life goes up 93% when raised in a sole-custody home.
State family courts operate unconstitutionally, without regard to the highest laws of the land by ignoring supreme court rulings, case law and the many fundamental guarantees of the constitution. Calling then “kangaroo courts” would be too generous as kangaroo courts at least go through the motions to pretend there is justice – family courts often issue judgments without a trial!  They intimidate, drive people into bankruptcy and tell people they “can’t win” and they are right because the game is rigged. It is basically a conspiracy to deny parents their rights for the profit of people in this FOR PROFIT system. Video by Minister Ron Smith.

Parental Alienation Links

As you know, I have been fighting being alienated from my two daughters for more than eight years. Recently I moved to Chicago and mom used it as an opportunity to once again attempt to end visitation by filing a report with DCFS, and seeking a two year order of protection that would cut off any and all communication with my daughters.

The DCFS report came back this week and was determined to be unfounded. I can add this to the two separate claims by mom that I molested the girls, and the other occasion where mom claimed I gave my youngest daughter narcotics. I have been attempting to reason with mom, but it looks like I will have to fight her in court once again if I am to maintain any relationship with my daughters.

Over the past two months I have been to many blogs of fathers who are also dealing with terminator mothers like Anna Jurich. This is a crisis that is rampant throughout our country. This will be an ongoing post to which I will be adding links to websites and blogs of fathers who are going through the same struggle. Dealing with mothers like Anna Jurich can be absolutely emotionally and spiritually exhausting, so it is good to be in contact with others with the same struggle.

The Nuclear Option in Child Custody – Sexual Molestation Charges

This is a great post I found on Men’s Family Law blog. As a last gasp, weeks before my visitation hearing, my terminator accused me of molestation. My lawyer told me she would probably try this option, and he was right. Some eight years later, Mom denies that this ever happened, even though I have the medical report. Mothers are the more likely parent to make the allegation that a child is being sexually molested. Frequently it is to prevent dad from getting visitation or custody, which increases the child support that he must pay. It is the nuclear option in a custody battle, and just like in the real world, it leads to the mutually assured destruction of the parties.

The emotional damage that is done to the relationship between the parents is nothing compared to the damage that is done to the parent/child relationship by a false allegation. As much as a false allegation increases the bitterness and anger between the parties, the suspicion it creates, and the spotlight of doubt that it casts on every activity causes a lasting harm to both parent/child relationships. The suspicious parent can become overly protective and begin to plant ideas in the child’s mind – which is abusive in itself. The suspected parent can become tentative in offering affection and love out of a fear of misinterpretation and potential criminal penalties.

First Alienated Weekend

This is the first weekend my children will miss with their dad do to the latest alienation attempt by mom. Like I have said before, this has been going on for over eight years. And as I told the kids weeks before I moved to Chicago, mom would spring into action to end visitation at any cost as soon as my car left the driveway. I departed for Chicago on a Friday, and on Monday, mom was getting an order of protection and filing abuse aligations with DCFS.

This is a quote from Judge Leo T. Desmond, from our visitation case some eight years ago. Anna Jurich was claiming that I was unfit to be a father, and that the children should not be allowed to ever see their father again. This is what the judge told Anna Jurich after a long litigation process:

At the conclusion of the hearing, the court commented on the evidence regarding visitation:

“The burden of proof was on her (Anna Jurich) to show a serious endangerment to these children’s moral, emotional, [and] physical health. She has fallen more than woefully short of the mark; she hasn’t even made out a case.

I have got a picture of the front of your house, which I guess I am supposed to conclude from that it’s not a very attractive house, I don’t know. Maybe there is some clutter in there, I don’t know. They have been dancing around the edge of the pen about marijuana. There has been no evidence other than this photograph. And, incidentally, since I was in [sic] the only one in this room besides the [c]ourt [r]eporter and these two people-the lawyers weren’t there at the last hearing-the marijuana wasn’t just put in because of [plaintiff]; it was put in because of [defendant].

So, moving back here, I have got photographs of sores on feet. I have got testimony about a sore eye. I have got a little bit here, and a little bit there. What I don’t have is[-]I don’t have any medical evidence[;] I don’t have any evidence of neglect or abuse. I don’t have any psychological evidence. I don’t have anything. I don’t have diddly squat to show serious endangerment, unless I am just guessing that that might be the case.”

Of course Anna Jurich filed an apeal, and of course she lost that as well. One of the most ironic things about this is that Anna Jurich is a adolescent councilor at Gateway Foundation in Carbondale Illinois! I guess she is realy good with kids.

The Mothers FOR Alienation Blog

Well all you fathers out in cyberspace land, it looks like the alienating moms found my blog. I’ve been getting traffic from what I will call the “obsessed alienation blog.” Looks like PAS is nothing other than a tool used by abusive fathers to abuse women!!

“I am a mother who has been labelled with PAS–not by any licensed medical
professional–but by a biased judge and my abuser and his sleazy lawyer Poor women do get labelled with PAS and Malicious  Mom Syndrome. I believe PAS is used against women as a form of  intimidation, a weapon used to force the mother to give up the fight or risk  losing everything.”

No point in arguing, just thought it might serve as a good example of how irrational and and twisted the thinking is in an obsessed alternators mind.

Misuse of Order of Protection: Mom the Terminator

Everyone knows. Any attorney will tell you. The Judge knows, the bailiff knows, and the court reporter knows. What do they know? They know that more often than not, terminator mothers use orders of protection, not as the shield that they were intended for, but rather as a sword to destroy the father.

No evidence is needed to obtain an order of protection. No filing fees, no attorney, nothing other than the claim that  “I’m afraid.” The father’s presence at the hearing is not required. A judgment can be issued against you with no opportunity to face your accuser. Your house can be taken away, your car, and your children can all be swept away in an instant.

One wrong step, one Christmas card sent in the mail, and bingo! Dad’s in jail! Heck, the father does not have to do anything, just the simple accusation from the terminator and off to jail you go. Forget about the new job you were to start on Monday. Forget about the money spent on bail. Oh, it could very well be thrown out in the end, but you still lost your job and your bail money, while the terminator walks unscaved.

In my personal case, I was charged with ten separate order of protection violations. Eight were dismissed. The two charges that I plead guilty to were sending Halloween cards to my daughters, and writing a letter asking to see the children for Thanksgiving. I was in jail for Thanksgiving that year for sending the Halloween cards. Trick or treat!

My terminator, Anna Jurich of Carbondale Illinois, had a personal relationship with her small town police department (the chief would often have dinner at her mother’s according to my daughters) and was able to time my arrests just before our OP hearing. This enabled her to delay my being able to receive a visitation schedule for many months. On the morning I was not in jail on the hearing date, I awoke to find all four tires slashed on my car.

Once, after I had received a temporary schedule under the OP, Anna Jurich was able to have the Christopher police waiting on a school bus ready to ambush me when I came to pick the girls up for a Wednesday visitation. I was arrested in front of my daughter’s school. The only time any violence occurred was when mom punched me at a drop off! My brother and I filed reports on this incident, but nothing was ever done about it.

I’ve had visitation with my daughters for the past eight years. Nothing has changed. The terminator can not be stopped. She has dedicated her life to destroying my relationship with my daughters.

Heck, I’m so afraid of my terminator, I think I need an Order of Protection! I bet she even tries taking legal action for me posting this article.
